Areas of Practice

Medical Negligence

  • Birth injuries — Failing to give mothers options for c-section or the less risky delivery options can result in unnecessary injuries to defenseless babies. Careless errors or improper technique during labor or delivery can leave the baby with permanent disabilities.

    • Shoulder/Brachial Plexus Injury

If your baby was stuck in the birth canal for too long or the physician used excessive force to deliver your child, one of their arms could be hanging limp or have less mobility than expected. There is a bundle or nerves called the brachial plexus that can be injured during traumatic birth. This is sometimes caused an Erb’s Palsy. This conduct during labor or delivery can be grounds for a malpractice case.

    • Head/Brain Injuries

Brain injuries can be caused by a lack of oxygen or oxygen-rich blood to your baby during labor/delivery. Traumatic birth from medical negligence can also cause brain bleeds or skull fractures. This can cause devastating impacts to your child. Park Woody Vaughan, P.C. has handled many similar cases and can help work through the process of achieving justice with you.

    • Cerebral Palsy

Cerebral palsy (CP) is commonly caused by medical errors during labor and delivery. Because CP often goes undiagnosed until months later when the child shows developmental delays, parents may not make the connection to difficulties at childbirth.

The medical malpractice lawyers of Park Woody Vaughan, P.C., know how to connect those dots to hold doctors and hospitals accountable. We have recovered compensation for Indiana families reeling from the economic fallout and personal struggles of raising a CP child that may manifest as:

      • Spastic cerebral palsy — Muscle contraction and short, jerky motion

      • Athetoid cerebral palsy — Random and uncontrolled movements in the limbs and face

      • Ataxic cerebral palsy —  Problems with balance, coordination and depth perception

      • Intellectual disabilities and cognitive problems

      • Seizures (co-occurring epilepsy)

      • Developmental and medical complications of the hips, spine, teeth, lungs, skin, internal organs

The symptoms are different from child to child, depending on the part of the brain affected, and may change or worsen over time.

  • Surgical errors — Improper technique by the surgeon, problems with anesthesia care, cases involving post-operative complications, and improper treatment of infections or other postoperative complications. Any of these errors by a surgical team can be cause for a medical negligence case.

  • Medication errors — Right Dose. Right medication. Right Patient. Right Time. Anything less is substandard.

  • Emergency department malpractice — The actions and decisions of ER doctors to send critically ill patients home without admitting them. Failing to run the proper tests to ensure the patient is not in a life-threatening condition. Misdiagnosis. Delayed Diagnosis.

  • Hospital negligence — Failure to monitor the patient. Nurses, radiologists, technicians and other hospital staff often cause or contribute to medical tragedies.

  • Nursing home negligence — Large infected bedsores, undiagnosed fractures, medical problems, or malnourishment may be a sign of substandard medical care at the facility.

  • Ambulance Treatment - Inadequate training, medical equipment, or improper response to emergency situations can be grounds for a medical malpractice case

  • Retained Surgical Instruments - Retained surgical devices, drains, staples, or medical equipment can result in serious complications.
